Why Hire in Peru

Expanding to Peru

Peru offers a growing, dynamic economy with an expanding talent pool in software engineering, customer operations, finance, and mining engineering. Its strategic location in South America and cost advantages make it a premier market for global recruitment.

An EOR solution lets you hire Peruvian candidates quickly while ensuring adherence to Peru's statutory benefit mandates and tax rules without setting up a foreign branch office.

Employment Laws

Employment Regulations in Peru

Standard working hours are maximum 8 hours per day or 48 hours per week under the Labour Productivity Act. Standard probation is 3 months, extendable to 6 months for skilled staff and 12 months for management. Arbitrary dismissal without cause triggers mandatory severance compensation equal to 1.5 months' pay per year of service.

Taxes & Benefits

Taxation and Employee Benefits

Employers pay 9% of salary for mandatory healthcare (EsSalud). Mandatory statutory benefits include 30 calendar days of paid annual leave, two bonus payments per year in July and December (Gratificaciones), Compensation for Length of Service (CTS), and mandatory life insurance (Vida Ley).

Payroll & SUNAT Filings

Peruvian Payroll Standards

Payroll is distributed on a monthly basis in PEN. Employers must deduct employee tax contributions and pension contributions (AFP or ONP) and file monthly payroll reports via the SUNAT PLAME system by statutory deadlines.

IP Rights & Data Governance

Intellectual Property and Data Security

Under Peruvian Copyright Law (Legislative Decree 822), rights to software and literary works created by an employee under employment automatically vest in the employer. Data protection complies strictly with Personal Data Protection Law No. 29733.
